Sold on eBay

So I was searching around eBay for a guitar to use on my PC and noticed someone trying to sell Frets on Fire for profit!

Now, I'm not going to jump up and start a rant, I don't know the legal-eze around open source, but to me, this is it shouldn't be allowed.
I noticed some of his feedback seems to indicate he is selling other free/open source software. Conveniently the auctions are private/hidden so I can't see what he was selling...
