Lets say:
1. I get my Xbox modded
2. I download games only to play OFFLINE, therefore I can't get caught.
3. POOF! I want to play a game online NAO!
4. I go and buy the game so I can play online with it.
~ Can I get caught online now?
~ If there is an update for a game will I get caught?

This shouldn't be discussed here at all but if I remember correctly: if Microsoft do detect your modded 360 they will ban its unique ID from their online service. You'll no longer be able to do anything on live without buying a new 360. I also remember reading something about Microsoft being able to detect it given certain parameters. Not sure what they are though.

No. A friend of mine has his 360 modded and he plays online all the time with his legit games.

I guess there's no way of them knowing weather you play illegit games. If you just play legit games online.

If you're pro like a pro you won't get banned, but chances are unless you really, really know what you're doing you will. It's not what game you're playing, it's the status of your Xbox
